Terms and Conditions
Scope of Application
The provision of conference and banquet rooms for the purpose of holding events, as well as all related services and deliveries, applies in the same manner to the provision of other rooms, wall spaces, and other areas.
Reservations
Reservations of rooms and spaces, as well as agreements regarding other services and deliveries, become binding for both Europahaus Wien GmbH and the organizer only upon confirmation by Europahaus Wien GmbH. Offers made are always subject to change. The provision of rooms, display cases, and areas constitutes a lease agreement.
Subletting or subleasing of rooms and areas is permitted only with the express approval of the Europahaus Event Center. Clients who are not also event organizers are jointly and severally liable with the organizers for the fulfillment of all agreements.
Prices
All prices are quoted in euros and include all taxes and fees. Prices are valid until further notice. Any increase in the sales tax rate shall be borne by the organizer. If the period between the conclusion of the contract and the provision of services exceeds 120 days, Europahaus Wien GmbH reserves the right to adjust prices.
We charge a €2.40 processing and accounting fee per event invoice or hotel invoice, as well as a €2.50 flat-rate energy cost and money transfer fee.
Please provide us with the desired billing address in advance. A fee of €25 will be charged for subsequent invoice changes.
For events with catering services
The organizer acknowledges that for events at which food is to be served, Europahaus Wien GmbH requires the exact number of participants and the menu selection no later than 14 days prior to the event. This number is considered a guaranteed minimum and will in any case be billed to the organizer by Europahaus Wien GmbH. Any additional orders for food, beverages, etc. will be charged separately.
Bringing in food and beverages for consumption on the premises is not permitted. Exceptions are possible in consultation with Europahaus Wien GmbH and upon payment of the standard service charges, as well as a corkage fee for bringing in special wedding wine.
Publication / Advertising
Newspaper advertisements and direct mailings containing invitations to events of any kind at the Europahaus event center require our written approval. If a publication is made without the consent of Europahaus Wien GmbH and this adversely affects the material interests of Europahaus Wien GmbH, the company reserves the right to cancel the event. The organizer shall bear any resulting costs, lost revenue, and potential claims for damages.
Music
If music, a film screening, or an exhibition is planned during an event, the organizer is requested to submit the legally required registrations to AKM or MA 36 in a timely manner and in person, and to submit the confirmed forms to Europahaus Wien GmbH for review one week prior to the event. All related costs are the responsibility of the organizer.
Quiet Hours
The legal closing time for the restaurant area is 2:00 a.m. An extension, if not already granted (please consult with the event team), can be requested through the responsible district police station (1150, Tannengasse 8–10, Tel. 31310-47160). We ask for your understanding that, as the venue, the Europahaus Event Center is obligated to ensure compliance with the various regulations, particularly regarding quiet hours. We expressly point out that the “unauthorized” setting off of firecrackers and similar items is prohibited within the city limits and thus also on the grounds of the Europahaus. The setting off of fireworks requires official approval and the consent of the Europahaus property management and may only be carried out by professional pyrotechnics companies.
Decoration
The installation of decorative materials or other objects is not permitted without the consent of Europahaus Wien GmbH. All decorative materials must comply with fire safety regulations.
Liability
The organizer is liable without proof of fault for any damage to or loss of fixed or movable inventory or equipment belonging to Europahaus Wien GmbH that occurs during the event or during setup or takedown.
Europahaus Wien GmbH or the Europahaus Event Center may require the organizer to take out appropriate insurance. Europahaus Wien GmbH assumes no liability for the loss or damage of items brought onto the premises. If these items are to be insured against fire, water, theft, damage, or any other risk, the organizer must arrange the insurance.
Payment Terms
(1) A deposit equal to the room rental fee must be paid to secure the date.
(2) 80% of the total booked amount must be paid by 21 days prior to the event. (3) Invoicing takes place after the event via email. Payment is due within 3 days, without deductions. Please provide us with the desired billing address in advance. A fee of €20 will be charged for subsequent changes to the invoice.
(4) In the event of late payment, the following applies:
a.) For consumer transactions (i.e., transactions between businesses and consumers) or for transactions between private individuals, a statutory late payment interest rate of 4% applies.
b.) For transactions between businesses (or between businesses and legal entities under public law such as the federal government, states, municipalities, ministries, associations, and federations), a statutory default interest rate of 8.58% applies.
Cancellations
(1) Up to 8 months prior to the agreed event date, the contract may be terminated by either contracting party via unilateral declaration, subject to a processing fee of 600 euros. The written notice of cancellation must be in the hands of the other party no later than eight months prior to the agreed event date.
(2) For cancellations up to 21 days prior to the agreed event date, the contract may be terminated by either party by unilateral declaration; however, a cancellation fee equal to the respective exclusive rental fee for the premises must be paid. The written notice of cancellation must be received by the contracting party no later than 21 days prior to the agreed event date.
(3) For cancellations made 20 to 11 days prior to the event date, the respective room rental fee plus 80% of the booked services will be charged. The written notice of cancellation must be received by the contracting party no later than 11 days prior to the agreed event date.
(4) For cancellations made 10 days or less before the event date, the respective room rental fee plus 100% of the booked services will be charged.
Even if the guest does not make use of the booked premises or the catering services, they are obligated to pay the agreed fee to Europahaus Wien GmbH.
Termination of the contract by the Europahaus event center
Europahaus Wien GmbH is entitled to terminate the contractual relationship at any time and without stating reasons if:
a.) the event impairs the smooth operation of the business
b.) the reputation or security of the venue is jeopardized
c.) in the event of force majeure.
Under no circumstances is the organizer entitled to assert claims for damages. The place of performance for all obligations arising from the contractual relationship is Vienna. The exclusive place of jurisdiction is also Vienna.
Legal smoking ban in all event rooms
We expressly draw your attention to the fact that the legal smoking ban must be observed in all our event rooms, even during “private events.” The organizer is liable for all damages incurred by Europahaus Wien GmbH as a result of any violation of the law by participants in their group.
